$100,000 Additional Fee: Not for Everyone

Some employers might ned to pay up to $100,000 additional fee if H-1B registrations are selected. This fee is potential.

What USCIS clarified:

  • Registration process remains unaffected from new presidential proclamation.
  • In the petition stage, an additional fee will apply.
  • Employer eligibility and future guidelines decide applicability.
  • Not all H-1B petitions will pay the additional fee.

Big Change: H-1B Selection Will Favour Higher Pay, Higher Skills

H-1B beneficiary selection process has become the hot potato this year. USCIS plans to ignore the random lottery. It can use a weighted selection system, but only if applications are many and they exceed the cap.

What’s changing?

How the policy shifts in visa allocations:

Aspect

Description

Policy Preference

Preference to:

  • higher-paid
  • higher-skilled workers

Evaluation Criteria

Weight given to higher compensation level roles

Primary Objective

Protect U.S. wages and domestic job opportunities

Impact on OPT Students

Salary level and job role may influence selection chances

Higher Fees Proposed for Certain H-1B Visa Petitions

H-1B Visa application fee has witnessed a hike. Some new H-1B petitions need a $100,000 payment requirement if they are filed from outside USA, according to a presidential proclamation.

This brings uncertainty in immigration policy. Higher budgets must be allocated when hiring international talent. The move becomes crucial as  March cap-season period is around the corner.

Potential Hiring Shift due to Wage-Based H-1B Lottery

  • In the H-1B visa, the traditional random lottery system is now in abeyance.
  • A wage-weighted selection process is in force.
  • A higher-paid applicant has better chances of selection in the H-1B lottery.
  • Impact could be seen in early-career hiring. Startup recruitment and research positions. Basically, if you have an average-paying job, your chances are low.
  • H-1B visa will see tough competition.

US Job Market Sees Surge in Demand for Global Talent

The demand of skilled labour force in AI and tech is rising. Reports say that in USA, around 70% AI-oriented courses have international enrollments. The changing immigration policy will have a stark effect on this population, which will ultimately affect USA’s technology workforce.

Companies Look for Alternative Options

H-1B visa rules are changing with strong curbs. Alternative visa and immigration options are now a part of corporate hiring strategies:

O-1 Visa

Individuals with extraordinary ability in science or technology

L-1 Visa

EB-1 Green Card

Accomplished professionals with outstanding achievements

EB-2 National Interest Waiver (NIW)

The Crux

Opportunities to study in USA are rising. But the grips are a little tighter. The selection process is selective. Students should focus on early preparation, strong job offers, and competitive salaries. Because in a landscape where you have to navigate through H-1B visa, these things matter more than ever.
